Z-Cut Privacy Policy

This privacy policy (“Privacy Policy”) explains the personal data Plotagon Production AB (“Plotagon”, “we” or “us”) collects and processes about you when you use our mobile application Z-Cut for Android and iOS devices (the “App” or “Z-Cut”) and the services provided therein (Z-Cut and all related services are collectively referred to as the “Service”).

This Privacy Policy also explains how and why we use your personal data and what choices and rights you have regarding your personal data. By personal data we mean any data that can be used to identify you or that can be linked to you.

Unless stated otherwise, Plotagon is the data controller for the personal data described in this Privacy Policy. If you have questions regarding this Privacy Policy or how we use your personal data feel free to contact us, for example by sending an email to privacy@plotagon.com. Please read this Privacy Policy carefully to understand how Plotagon may collect, use and share your personal data.

How we use your personal data

Plotagon uses personal data for the following purposes:

  • Providing the Service. We use personal data to provide access to and operate the Service. This processing is necessary for the performance of the agreement we have with you.

  • Providing customer support. We use personal data to respond to customer enquiries, provide customer care and support services. Such support includes but is not limited to technical support. This processing is necessary for the performance of the agreement we have with you.

  • Service improvements. We use personal data to develop and improve the Service, including maintaining and improving the performance of the Service as well as developing and adding new features or capabilities. This processing is necessary to serve our legitimate interest to develop and improve the Service.

  • Receiving payment. We use personal data to receive and report our payments. This processing is necessary for the performance of the agreement we have with you and to fulfil legal requirements regarding accounting, among others.

  • Business Operations. We use personal data to aggregate business information that enables us to operate, protect, make informed decisions, and report on the performance of our business. This processing is necessary to serve our legitimate interest to operate our business.

  • Marketing and Advertising. We use personal data to show ads in the Service for other products and services as well as to promote Z-Cut. This processing is necessary to serve our legitimate interest to provide our Service and receive revenue from it. Targeted advertising based on profiling is shown only if you have consented to cross-device tracking on your iOS or Android device.

In addition, we may use and disclose personal data when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with Plotagon’s rights or property. This processing is necessary to serve our legitimate interest to protect our Service and Plotagon as a company.

The personal data we collect

Depending on how you use the Service and what plan you sign up for, we may process the following personal data:

  • Log-in information such as email and password to create and verify your user account.

  • Voice recordings if you upload such to the Service.

  • Information provided when communicating with us by email, web forms, or contact us by mail or other offline means.

  • Automatically collected general technical data about your device.

  • Redacted payment information received from a third-party payment service provider.

  • Advertising identifiers generated by Android or iOS that allow online advertising.

  • Information on how you interact with our ads.

Automatically collected technical data There is certain information that we collect automatically as the result of your use of the Service. We may, for example, collect information about the type of device you use to access the Service, the operating system and version, your general geographic location (country, region and city), timestamp, language of the operating system, and internet connection type (eg. WiFi).

Information received from other sources In order to provide secure payments, we use well-renowned third-party payment service providers in our check-out. The payment provider is the service you used to download the App, such as App Store or Google Play Store.

To collect payment from you, these service providers need to access your payment information. These service providers have an independent responsibility for the data that they collect as part of providing requested payment services. The service providers are considered as the data controller for the transaction and payment data and are responsible for your data being processed in accordance with the GDPR as well as other applicable laws to ensure secure transactions. The service providers provide us with device information, a payment ID, approximate location and information that payment is completed.

We also use advertising identifiers to show ads to our users. Advertising identifiers refer to the Google Advertising ID on Android devices, and ID For Advertising (“IDFA”) or ID For Vendor (“IDFV”) on iOS devices, received from Android and Apple respectively. The Advertising ID is a resettable persistent identifier generated by Android or iOS that allows online advertising companies to recognize your device across non-affiliated apps, for purposes of providing personalized advertising.

Childrens’ personal data

To use the Service you have to be at least 13 years old. We do therefore not knowingly collect or process any personal data of children.

How we may share your personal data

Your data can only be accessed by persons who need the data to provide the Service, such as our employees and consultants. Besides our employees and consultants, we use certain partners to help us provide, improve, promote, and protect our services. For example, we use suppliers to manage marketing, data storage, and web hosting on our behalf.

For our partners to perform their services, it is sometimes necessary for us to share your personal data with them. These suppliers may only use your personal data in accordance with our instructions and we only share such data that is required to perform the service in question. We do not sell any personal data to partners or any other third parties.

Disclosures by law

We may share personal data to authorities or other third parties when required by law or regulations or when it is necessary in order to protect or defend our legitimate rights and interests, or those of our users, employees, directors or shareholders, and/or to ensure the safety and security of the Service.

Sale of assets

Subject to a merger or sale of Plotagon (in whole or in part), your personal data will be shared with or transferred to the merged or buying entity. In such a case, your personal data will continue to be processed in accordance with this Privacy Statement.

Aggregated Data

We may pseudonymise and aggregate your personal data with similar data relating to other users of the Service in order to create statistical information regarding the Service and its use, which we may then share with third parties or make publicly available. However, none of this information would include any information that could be used to identify you individually.

For how long we store your personal data

Plotagon will store your personal data for as long as we deem it necessary to provide the Service to you and to comply with applicable laws (including those regarding document retention), resolve disputes with any parties and otherwise as necessary to allow us to conduct our business. All personal data we retain will be subject to this Privacy Policy.

We will send you a reminder by email if you have not accessed your Plotagon account during a two (2) year period. If you have not accessed your account within ninety (90) days after receiving such notification, your account and related personal data will be permanently deleted, unless we are legally required to retain the information for a longer period of time.

International transfers of personal data

The personal data that we collect about you is mainly processed (and stored) in the EU, but may be transferred to any other country where Plotagon’s affiliates, subsidiaries or service providers are located or maintain facilities. Before transferring personal data outside of the EU/EEA, Plotagon will ensure adequate mechanisms to protect personal data when it is transferred internationally, for example by using the Standard Contractual Clauses as approved by the European Commission and, where necessary, taking additional safety measures to ensure that the recipient will uphold an essentially equivalent level of protection to EU data protection standards.

Your rights to your personal data

You always have the following rights in relation to your personal data:

  • The right to access your data. You always have the right to understand what personal information we collect and share. You have the right to ask us for supplementary information on why we process your data, what data we process, how long we store your data (or what criteria we use for determining the storage period), who we share your data with, and whether your data is transferred to countries outside of the European Economic Area.

  • The right to correct inaccurate information. You always have the right to correct or ask us to correct any inaccurate data about you. The right to request erasure or restriction of your data. You have the right to have us erase or restrict the use of your data that is no longer needed for the purposes for which we collected the data. You also have a right to object to any processing you find unlawful or unnecessary for the informed purposes.

  • The right to information on the source of data we collect. You have a right to get information on the source of information that is not provided by you and about automated decision-making, such as profiling.

  • The right to data portability. When technically possible, you have the right to get your data transferred to another service.

  • Right to non-discrimination. You have the right not to receive discriminatory treatment for the exercise of your privacy rights.

You may request the disclosures described above by sending a request to privacy@plotagon.com. You have the right to make two (2) free requests during any 12-month period. We will make the disclosure within 30 days of receiving your request, unless we request an extension, in which case we will notify you of the extension within the given time period.

Please note that there may be restrictions for us to erase certain personal data, such as personal data we are required to store by law or regulations.

Plotagon is always committed to handle any request, complaint or concern that you may have about our use of your personal data in a lawful, fair and transparent way. If, however, you believe that we have not been able to assist with your complaint or concern, you have the right to file a complaint with the Swedish Authority for Privacy Protection (https://www.imy.se), or supervisory authority in your country of residence.

Security and data breaches

We use appropriate technical and organisational measures to protect your personal data against unauthorised or unlawful processing and against accidental loss, destruction or damage. Your personal data is stored in a secure manner on protected equipment. For example your data is protected with encryption, such as Transport Layer Security (TLS), during transition over the Internet. Only a limited number of personnel have access to our equipment and only persons with a legitimate reason have access to your personal data. Unfortunately, the transmission of your personal data via the internet is not completely secure. While we will endeavour (through the use of appropriate security measures) to protect your personal data, we cannot guarantee the security of such data when it is transmitted to us via the internet. We also ensure that our third-party data centre vendors provide adequate security measures.

Changes and Updates to this Privacy Policy

Occasionally we may, in our discretion, make changes to the Privacy Policy. If we make material changes to the Privacy Policy, we will provide you with prominent notice as appropriate under the circumstances.
